Policies + Terms and Conditions For Bluegrass Playgrounds, Inc.


All prices are F.O.B. Factory and most products are shipped ‘knocked down’ and will require some assembly. Pricing does not include delivery or installation costs. We reserve the right to change pricing without notice. We accept all major credit cards, bank checks, money orders, wire transfers , direct deposit, or qualified 30 day net government purchase orders.


Ordering with Bluegrass Playgrounds is simple. If you are a government institution, you’ll just need a signed purchase order and a copy of your quote faxed to our toll free fax number (1-866-271-4011). Terms will be 30 day net. All other customers can either order over the phone with a valid credit card, with details regarding an immediate advance check, (tracking is required for ground mail delivery for advanced check payments). All orders must exceed $30.00 or a handling charge will apply.


Prices on our website do not include shipping charges. We shop for the cheapest freight to ship your playground equipment. Some items ship via UPS, USPS or Fedex Ground, and most ship via ‘truckline freight’. We will email you a quote with shipping charges. Prices are subject to change without prior notice. Orders will ship unassembled and large items delivered by common carrier, delivered ‘curbside’ to the address specified on your order. Your curb location should be accessible to large freight truck if ordering larger playground equipment. The carrier is not responsible for unloading and is not responsible for offload for reasons such as union policy, insurance etc.

Residential delivery, ‘call ahead’, ‘lift gate service’, inside deliveries are (mostly available in your area) for an extra charge. These specific requests must be specified on our quote when ordering. Customer’s responsibility is to check to see that they are receiving the same number of cartons, bundles, pallets, welded frames, etc indicated in the delivery receipt. Do not sign the bill of lading unless you have counted and inspected the items. Customer special services must be requested before shipment to avoid incurring re-delivery charges.


Note any shortages or visible damage on your receipt and have the driver note it also. No notation means there is no recourse for any damages or shortages noticed after the shipment was receive.

Trucking companies don’t accept damage claims after the fact. The only way we can file a claim to get you a replacement is when the damages or shortages is noted in the delivery receipt. If there are concealed damages, please contact Bluegrass Playgrounds Customer Service right away.

You are given 5 days from receipt to report concealed damages. Take photographs of the delivery and equipment to document shortage or damage, and send to us.


Bluegrass Playgrounds Inc. is a ‘distributor’ for many American factories. Therefore all qualified and ‘pre-approved’ order-cancellations incur a minimum fee of 25% of MSRP price from Bluegrass Playgrounds Inc., (in addition to ) a 35% – 50% of MSRP cancellation fee (by the specific factory of origin). Due to the great possibility that expenses associated with your order may already have occurred, (and), that many of our products are ‘made to order’, ‘customized by customer’, custom color selections, (or items made to ‘comply with customers local government building codes’, etc.), expenses have been already associated with and have been incurred by the order.

Therefore, any product that has been deemed ‘customized, ‘special order’, or made to conform to your local government codes may not be cancelled after being placed into factory production. Examples of a ‘custom order’ include: customized modular playsets, and all ‘shelter’ orders. Shelters are each customized for ‘wind and snow loads’ for an exact customer-supplied physical address and zip code in their county. Engineering ‘seal’ (approvals) from local governments are a mandatory part of the ordering process, rendering the inability for the factory to ‘re-stock’ components of the ‘custom order’.

Regarding smaller orders:
No cancellations are allowed on orders that have shipped.

All cancellations must occur before order is placed into production.

No cancellations are allowed after factory production is completed.

Note: Due to expenses associated with any order, Bluegrass Playgrounds Inc. must pre-approve a ‘hard copy form’ (a written, qualified, customer ‘cancellation of order’ request’. At that time, the customer will be shown itemized cancellation fees, expenses incurred, and/or approval or disapproval of an order cancellation.


Taxes may be added to your quotation or invoice unless a satisfactory state resale certificate or tax exempt certificate is provided before ordering.


Returns will not be accepted without prior written authorization. Returns should be within 30 days from the date the equipment is received. Restocking charges of 25% of Bluegrass Playgrounds MSRP price, plus factory return charges of 25% of factory MSPR, plus freight charges (to and from) your location will apply. Absolutely no returns on equipment that has been installed or partially installed, custom orders, and on wood fiber, rubber nugget or tile surfacing. The following other reasons to dis-qualify for returns or partial refund: – Items without a RMA (Return Merchandise Certificate), – any customized, made-to-order structure, equipment, Shade or Shelter structure, Site Amenities, items where cost is below $50.00, any item which is past 30 days of the original sale, any item attempting to be returned via ‘freight collect’. Returns are never delivered to Bluegrass Playgrounds Inc. but rather to the factory of origin.


Due to the possibility of type errors on our website , or on our older print catalogs, we reserve the right to change without prior notice the following: fluctuations in raw material costs, sale prices, discontinued items, policies and descriptions etc.


All items are warranted by the manufacturer. Bluegrass Playgrounds does not warranty products personally. You may request from us to send you any warranty information that you may need from the manufacturer of origin.

Bluegrass Playgrounds disclaims liability for any loss, injury, or damage arising from the use of an item sold by us. Any item delivered to be proven defective will be replaced by, returned to, and shipped from the factory of origin, after a written authorization, set of instructions, and charges have been authorized.

Warranties apply to structural failure caused by defective materials, or defective worksmanship, and with normal use and proper maintenance and installation. Damages from misuse, vandalism, lack of maintenance, improper installation, unauthorized repairs or modifications, acts of God or acts beyond manufacturer’s control, or cosmetic issues such as scratches, dents or fading of colors, are not covered by the warranty nor does the warranty cover the cost of freight to or from the customer, nor labor for the removal and installation of repaired or replacement parts.

Warranties are limited to repair or replacement of defective parts. A repaired or replacement parts is covered only for the original warranty period. All warranties begin on the delivery date of the goods. Warranties are non-transferable.


A soft resilient surface should be placed under all playground equipment to cushion accidental falls. The “use zone” to be covered and depth of cushioning vary with the type and height of equipment, as described in section 10 of the Handbook for Public Playground Safety published by the Consumer Products Safety Commission. It is important for all owners and users to follow these guidelines. Manufacturers cannot accept liability for playground that is improperly installed, improperly maintained, or improperly used.
